Customers may only purchase Goods through my website if they are at least 18 years of age.

If Goods are being ordered from outside the United Kingdom, import duties and taxes may be incurred once your Goods reach their destination. I am not responsible for such charges and I undertake to make no calculations or estimates in this regard. If you are buying internationally, you are advised to contact your local customs authorities for further details on costs and procedures. As the purchaser of the Goods, you will also be the importer of record and as such should ensure that your purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and We cannot guarantee that the packaging of your Goods will be free of signs of tampering. Please also be aware that United Kingdom consumer protection laws may not apply.

Goods, Pricing and Availability
I make all reasonable efforts to ensure that all descriptions and photographical representations of products available correspond to the actual items, nearly all of which are individually photographed. Please note, however, the following:Images of Goods may appear differently according to the settings on your computer with regard to colour or hue. There may be slight variations in colour between the image of a product and the actual product therefore. Wood is a natural product and with that unless cared for properly it can develop faults eg items need to be kept out of the sun and other forms of direct or excessive heat, fires, cookers etc and of course kept away from and out of water etc Delivery charges are not included in the price of Goods on my website they are added during the checkout process according to the weight of the item including the packaging and the delivery destination.

Orders – How Contracts Are Formed
My website will guide you through the ordering process. Before submitting your Order to meyou will be given the opportunity to review and amend it. Please ensure that you have checked your Order carefully before submitting. No part of my website constitutes a contractual offer capable of acceptance. Your Order constitutes a contractual offer that I may, at my sole discretion, accept. The acknowledgement of receipt of your Order does not mean that I have accepted it. My acceptance is indicated by a Dispatch Confirmation.
If, for any reason, I do not accept or cannot fulfil your Order, no payment shall be taken. If I have taken payment any such sums will be refunded to you as soon as possible and in any event within 7 days.

Payment
Payment for Goods and delivery must be made in advance and you will be prompted to pay during the order process. I accept the following methods of payment :Preferably a Secure Direct Bank Account Payment PayPal or Cheques made payable to Tommy Woodpecker Woodworks sent to the address information on the site, (no items paid for by Cheque will be dispatched until the cheque has been received and cleared).

Our Liability to Consumers
I will not be responsible for any loss or damage that is not foreseeable.
I will not be liable for any failure or delay in performing Our obligations where that failure or delay results from any cause that is beyond my reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, industrial action by third parties, civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism, acts of war, governmental action, epidemic or other natural disaster, or any other event that is beyond Our reasonable control. If any event described occurs that is likely to adversely affect my performance of any of my obligations under these Terms and Conditions:

Delivery, Risk and Ownership
Larger items are sent by courier by arrangement and charged separately. I pride myself on my customer feedback. I want you to be delighted with your purchase. Do not hesitate to email me if you have any problems
All Goods purchased are dispatched the next working day after payment has been received to the delivery address supplied. If items are lost via Royal Mail you need to claim for your loss via Royal Mail. Our proof of postage is always retained. Should you want signed for delivery please add £1 to any payment made and specify this in your order.By law, We must provide goods that are of satisfactory quality. If any products have faults or are damaged when you receive them, or if you receive incorrect Goods, please contact me as soon as possible to inform us of the fault, damage or error, and to arrange for a replacement, refund, or repair. On delivery, inspect your Goods and if there are any problems contact us immediately. If you use the Goods in a manner that is inconsistent with their purpose we are unable to replace them. Before accepting the Goods you will be entitled to reject them and receive a full refund (or a repair or replacement if you prefer it) if the Goods are not of satisfactory quality, unfit for purpose, or do not match their description. If you have accepted the Goods, you are no longer entitled to a full refund in which case you may request a repair or replacement. If a repair or replacement is not possible, or would impose a significant burden on me, or could not be performed within a reasonable time and without significant inconvenience to you, you may opt either to keep the Goods at a reduced price, or return the item, paying the return postal costs yourself and cancel the Contract. . If you are rejecting the Goods and claiming a full refund you must prove that the Goods were not of satisfactory quality, unfit for purpose, or did not match their description when you received them.
You may not return Goods because you have changed your mind. If you are a consumer in the European Union you have a legal right to a 14 calendar day cooling off period within which you can return Goods for this reason. To return Goods to Us for any reason you will be fully responsible for the costs of returning Goods
Repairs or Replacements issued will be dispatched within a reasonable time. Refunds (whether full or partial,) will be issued within 7 days of receipt of the returned item.
If you wish to exercise your right to cancel within the 14 days, you must inform us of your decision within the cooling off period.. Cancellation by email or by post is effective from the date we received your cancellation preferably by email to [email protected] please put Cancellation Notice in the subject header. We may ask you why you have chosen to cancel and may use any answers you provide to improve our Goods and services, however please note that you are under no obligation to do this.
Please ensure that you return Goods in no more than 14 calendar days after the day on which you have informed me of the cancellation. Please note that you must bear the costs of returning Goods to me. The cost of returning Goods should not normally exceed the cost of having them originally delivered. Refunds may be reduced for any diminished value in the Goods resulting from your excessive handling of them, “excessive handling” means any more handling than is reasonable required to ascertain the nature and characteristics of the Goods in question.How I Use Your Personal Information (Data Protection)

If you do opt to cancel, you must return any affected Goods you have already received and I will arrange for a full refund paid within 7 days of your cancellation.

These Terms and Conditions, and the relationship between you and me (whether contractual or otherwise) shall be governed by, and construed in accordance with, English law. If you are a consumer, any disputes concerning these Terms and Conditions, the relationship between you and I, or any matters arising or associated whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England and Wales. If you are a business, any disputes concerning these Terms and Conditions, the relationship between you and I, or any matters arising or associated (whether contractual or otherwise) shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Postal delivery times, particularly overseas are beyond my control, so please don’t leave it to the last minute to order your item in order to avoid any disappointment, allow plenty of time for overseas delivery. If for any reason you need to return an item to me please do so immediately and contact us, you will need to cover the costs for return of the item and I will replace or refund you.

Postal Charges
I send everything first class post with proof of postage. Postal Charges are based on the weight including packaging. All items are carefully wrapped and packaged in order to reach you safely and are gift ready with labels and care instructions included. Wherever possible cardboard is recycled. I cannot take responsibility for any customs charges that may apply, or items lost in the post, I retain proof of postage. Where postal costs have been under-estimated I usually cover the difference. None of the above affects your statutory rights.
